Ashford to be One of the First Councils to Receive Section 106 help

Ashford Surveyors – It has recently been announced that Ashford Council will be one of the first to receive assistance from the Government’s new team of negotiators, tasked with mediating in stalled 106 negotiations. An estimated 1400 construction projects across the country have been moth-balled and this scheme hopes to get them up and running once again.

Solihull Secures Landmark Tenancy Succession Victory

In a complex battle of conflicting statute versus common law positions, Solihull Metropolitan Borough Council (Birmingham) has finally won out in the Supreme Court, marking a new precedent for future cases of joint tenancy succession.

The case dates back to 1967 when Mr and Mrs Hickin became joint tenants of a property in Chelmsley Wood, Solihull, under a tenancy later made secure by Part IV of the Housing Act 1985.

Barnet Tenants Battle Floating Warden

London Surveyors – Two tenants from Hanshaw Drive, Edgeware in the London Borough of Barnet have claimed that their local authority is in breach of its tenancy agreements by introducing plans to introduce a floating warden for sheltered accomodation.

The campaigners believe that the new service would put the lives of tenants and pensioners at risk and a judge in Barnet County Court has order a delay whilst court proceedings continue.

Bristol Landlord fined for Flyposting

bristolbuildingsurveyors.co.uk -The landlord of a pub, the Black Swan in Easton, Bristol, has been fined £11,000 for ‘flyposting’.

The punishment is for putting up posters on lamposts, street hoardings and other items of street furniture without permission. The council reputedly removes thousands of posters every year, and had highlighted the areas the landlord, Mr Melford, had illegally installed the posters, giving him an opportunity to take them down. Having been ignored, court proceedings were brought. Mr Melford did not attend the hearing.

The Housing Act 2004 and the Tenancy Deposit Scheme – A guide
